Should NY State have denied my submission of a request for the Earned Income Credit for 2016 based on the information supplied below?

For 2016, Turbo Tax indicated I should receive an Earned Income Tax credit both Federally and for NY State.  No problems with Federal.  Many problems with NY State.  My earned income was under $7,000.00 my investment income was way under $3,400.00; I am single, age 25 at the end of 2016 with no dependents.  In a telephone conversation with a rep from NY State I was told I was not eligible because my age (25) at end of 2016 disqualified me from claiming this credit.  I see nothing in the NY state form or its instructions (IT 215) which justifies this dis-allowance.  I believe I entered all information correctly when prompted by Turbo Tax and reviewed the IT 215 created and all seems proper.  Am I missing something?

Did you ask the NYS rep for the code section that says that?

Did you claim a Federal EIC?  Is your DOB correct on your tax filing?

New York State and New York City who qualify for the federal EITC also qualify for an EITC on their State and City income taxes.

If you are denied the EITC, you can appeal the denial. The notice you get from NYS will tell you how to appeal, and the time limit for filing an appeal.  Send a copy of your birth ceritificate with the appeal.
