Tax form IT-209 is for use by New York State residents who want to claim the noncustodial parent earned income tax credit. The filer can claim either the NYS earned income credit, or the NYS noncustodial parent earned income tax credit, but not both. To qualify for the credit, during the previous tax year one must have: resided in New York State, been 18 years of age or older, and had minor children who resided elsewhere. Several other conditions must also be met to qualify.

You must enter the children that you pay child support for as dependents in your personal information section then it will ask clarifying questions that allow you to list children as a "non-qualifying dependents." Then when you go into your state forms, it gives you the option to add child support payments as a credit.
