Yes I don't have an agreement with my childs mother on who can claim our daughter but she lives with the mother but however I pay child support can I claim her?

The custodial parent is the parent who can claim the child as far as the IRS is concerned.  Child support is not deductible, and without an agreement from the other parent, you cannot claim the child.
