Can I claim a vehicle as "I own it" for a business depreciation purpose if it was purchased after we were married together but the vehicle was only under my husband name?

I am a small business owner. My husband and I have been married since 2008. On 2009, we purchased a car. Since it was going to be mainly my husband's car, it has been under his name only on the vehicle title. In summer of 2018, I gifted away my old car and have been using the car mentioned above for the business as well as a personal purpose. Though the car has been under my husband's name, can I claim it as "I own it" for the depreciation-write off purpose? We are still married.
