Why would Tur.Tax allow me to select "other parent" is claiming our son as a dependant but still give me the EIC (not CTC) preventing him from being able to claim him?

My Sons father was to claim our son as his dependant. On my tax return, I selected that the OTHER parent is claiming him. We live together. I received an EIC, which I thought was just my general income credit, I dod not receive a child tax credit (because I selected that the other parent was claiming him) 

Tur.tax gave me the EIC for my son and now his father cannot claim him as his dependant or file head of household and neither of us are getting the Child tax credit. His father is not filing until I can get this resolved. 

Do I have to amend? It seems like that is going to take forever and the tax deadline will be up by the time I get it figured out .

That's because of the way you answered the questions..  If you are the parent with whom the child lives more nights out of the year, you can pass the dependent on to the other (noncustodial) parent but that parent can only claim the childdependent credit and Child Tax Credit.  The Earned Income Credit and the Child Car Credit remain with the custodial parent.  

If the parents are unmarried and live together with their child, you should  not have entered the child at all on your return and would now have to delete the child altogether.


Amendments have to be filed on paper ans it will take the IRS up to 16 weeks to file the return.
