Why is my daughter's father unable to file my child on his taxes if I didn't file her on mine?

Your child would have to live with her father over half of the year to be a Qualifying Child for either the Child Tax Credit or the Earned Income Credit.

We have 50/50 and he has filed her before.

One of you has to have 1 more nite than the other... 50/50 won't work work for taxes.. so he needs to indicate 'over half the year' in order to claim her.
