Who should claim the 1098-T our daughter or us?

My daughter is a full time student who wants to declare residency in CA so we are not claiming her on our taxes. We did pay tuition for her and need to know whether we should take the credit or her. It seems like it would be more beneficial to us but then will it effect her residency.

Who should claim the 1098-T our daughter or us?

If you are not claiming your daughter as a dependent on your tax return then you would not claim the 1098-T.  However, her "residency" status would have to be determined by the criteria determined by the  state and/or her university .  Sometimes that will require that she file a state return as a independent taxpayer but you would have to review what her university/state will require.  If she decides to file her own tax return and claim her own exemption then you would not be allowed to claim the 1098-T or any of the education expenses on your tax return.
