What types of taxes should L1 non-resident should file who have foreign asset and have invested in Us stocks?

As an L-1 non-resident, you may need to file:

  • Form 1040-NR for all  U.S. income, including investment trading income. Form 8938 for foreign assets over $50,000, and FinCEN Form 114 if foreign accounts exceed $10,000. Additionally, use Form W-8BEN to certify your foreign status and claim tax treaty benefits. 
  • U.S. Stocks: Yes, you can invest. Report income on Form 1040-NR
  • You contribute to a 401(k) through your employer only.
