Stayed all year in 2024, am i eligible to file as a resident for tax purposes (MFJ)?

Hi,

 

I arrived in the US in Aug 2023, been working part time and student full time, haven't left the US since. I got married in 2024. Am I eligible to file 2024 taxes as a resident for tax purposes, and am I eligible to file online with my wife Married Filing Jointly without the need to mail them a declaration letter that my wife and I consider me a resident for this year's taxes?

 

We met with a tax accountant at our university who said since I have stayed for more than 183 days in 2024 then I'm eligible to file as a resident for tax purposes. I just don't want to mess anything up.

 

What do I select when filing taxes with my wife on turbotax?

Yes you may file as a US resident alien on a 1040. You may also elect to marry filing jointly and elect to have your wife declared a resident alien for tax reporting purposes. There is a section in Personal INFO where you will indicate you wish for your wife to be treated as a US resident for tax reporting purpose. Once you select this, there will be a statement that is generated in your return attesting to this fact thus you won't be required to mail in a separate letter.

 

Here is the screen that you will use to make the election to treat your wife as a US resident.
