No, 2 months qualifies for a short gap exemption.  When you are selecting the months you had insurance, if you had insurance for any part of the month you would select that you had insurance for that month. So since you had 2 months and 7 days without insurance, the rest of the month you would have had insurance so you would select that you had coverage for that month.

The company was bout out .so I had to be on a 90 day probation period with new owner then was laid off.

So you didn't have insurance for 5 months or 2 months?

The new people bought out the company September 20th and you had to be on a 90-day probation. Before I can get any benefits with the new bosses but I was laid off December 7th.

So then yes, you would be subject to a penalty as that would be 3 months without insurance. You may qualify for an affordability exemption.
