Return rejected for no 8862 form but we do not qualify for American Opportunity Credit+ we did not take it. Can't file without one? But don't need one?

The education credit is calculated on Form 8863. Form 8862 is for the Additional Child Tax Credit and/or Credit for Other Dependent.
