No, only the parent that a child lives with can claim the earned income credit whether or not that parent claims the child as a dependent. You are the one who is eligible for this credit. Please view the qualifications for claiming the earned income credit for more information.

I'm not claiming my children due to my gross income being less I live with my children's father do I still need to file form 8332 even if we have a verbal agreement
