If he claimed the dependent on his 2019 return, he would.
Here is what the IRS says:
"Eligible taxpayers who filed tax returns for either 2019 or 2018 will automatically receive an economic impact payment of up to $1,200 for individuals or $2,400 for married couples and up to $500 for each qualifying child.
For people who have already filed their 2019 tax returns, the IRS will use this information to calculate the payment amount. For those who have not yet filed their return for 2019, the IRS will use information from their 2018 tax filing to calculate the payment. The economic impact payment will be deposited directly into the same banking account reflected on the return filed."
But what if I claimed my children in 2018 and filed hoh...and have not filed 2019 bc I did not have income, But my boyfriend filed hoh in 2019 and claimed my children. Who will get to claim the children in this case??
As you have not filed a 2019 return, the IRS will use your 2018 tax return for your stimulus check. As you claimed the children in 2018 and your boyfriend claimed them in 2019, it will just depend on which one the IRS processed first. According to their information, they are processing checks for taxpayers that filed a 2019 return first before processing checks for taxpayers that filed for 2018 and have not yet filed for 2019.
Eligible taxpayers who filed tax returns for either 2019 or 2018 will automatically receive an economic impact payment of up to $1,200 for individuals or $2,400 for married couples and up to $500 for each qualifying child.
This is our exact situation and we both received $500 for our son. Now I don’t know what to do. The IRS is closed and I don’t want to get penalized for this. Wondering if you too got double paid for your child?
What were the filing statuses for you and your boyfriend. Please provide additional information so we can answer your question.
IRS has stated that any stimulus payment you get will never be clawed back for any reason.
You have nothing to worry about.
Hello I had a question!!!
I filed my taxes for 2019 and I claimed my two kids . My boyfriend claims them this year! Would I still get mine and the kids stimulus for the 3rd round? I'm stressing out!!! Please help! Thank you!
As of now, We don't have specific information on the income qualifications or procedures for the third stimulus payment because the measure hasn't been passed yet although it is projected to pass.
As of now, we cannot tell which of you will receive the stimulus check because we don't know if it will be based off of the 2018-2019 tax years or based off of the income in 2020. If it is based on the 2020 tax return, then your boyfriend will receive the check.
We should have more information once the bill officially passes.
Did you ever figure out what happened? This just happened to my boyfriend and I this time around for stimulus package
You can check the status of your stimulus through the IRS website using your IRS Online Account. You can also use the IRS stimulus tool.
