Married Spouse NO SSN/ITN

Hi 

I am a permanent resident filling to claim my recovery rebate for 2020. I am married with 0 income. My spouse is a non resident alien who lives abroad with no SSN/ITIN.

Do I still need an ITIN if I don't claim exemption for my husband. I only need to get my Stimulus payment for last year.

Married Spouse NO SSN/ITN

No. An individual who has an individual taxpayer Identification number (ITIN) does not qualify for the stimulus payments or the Recovery Rebate Credit. In addition, married individuals who file jointly generally will not receive a payment if one spouse has an ITIN. 

 

To qualify, you must be a U.S. citizens, permanent resident or qualifying resident alien and have a Social Security number valid for employment.

I am a green card holder, and I want to claim my own stimulus payment from last year.

I want to fill MFS and not claiming exemption for my husband.

Does my husband still needs ITIN?

Married Spouse NO SSN/ITN

No. Your husband does not need an ITIN if you are filing separately. You will not be able to e-file. If your spouse doesn’t have and isn’t required to have an SSN or ITIN, enter “NRA” in his Social Security number box.
