401(K) distribution while in California used to move to Nevada

BACKGROUND

I am over 59 1/2 and I took a 401(K )distribution at the beginning of the year while I was living in California with the goal to use the money to move and live in Nevada prior to June 30th.  I moved to Nevada and registered prior to June 30th.

QUESTION:

Am I entitled to a refund on the California taxes that were withheld on my 401(K) distribution at the beginning of the year while I was living in California?

401(K) distribution while in California used to move to Nevada

Hi,

Sounds like you were a resident of California for part of 2022 and a resident of Nevada for the rest of the year.  That would make you a California part-year resident, and you would need to file a California part-year resident return.  As a part-year resident you pay tax on:

  • All worldwide income received while a California resident (including your 401K distribution)
  • Income from California sources while you were a nonresident

Here is some information from the CA FTB that also has some scenarios that may be helpful to you.
