How can I separate my filing from this issue? Can she pay separately?
My refund was taken to pay due taxes from before, I was not aware of. It looks like my wife had income from gambling from 2010 and never reported. What can I do at this point? She mentioned that I should had file married separated and that she was going to take care of the taxes due. Since I have filed for the last years under my name, as primary, is those taxes fall under my name, my SS Number? Can you clarify that?

Ok ... I will assume that you are no longer married to that wife ? But you were when you had filed a joint 2010 return the IRS will take the taxes due from the first person who files a return no matter who is responsible for the debt. If that spouse agrees that they owe the tax bill then they can pay you for the refund the IRS took from you ... there is no way to undo this with the IRS.

If that spouse agrees that they owe the tax bill then they can pay you for the refund the IRS took from you ... there is no way to undo this with the IRS.
