Need to do Injured spouse form 8379, but it is mixed in with the 8857, to complicated to determine what parts need to be filled out

Need to do Injured spouse form 8379, but it is mixed in with the 8857, to complicated to determine what parts need to be filled out

It may be best to start injured spouse over by first deleting the innocent spouse and injured spouse forms:

To delete:

  • Once in your return, click on My Account on the blue dashboard and choose Tools.
  • Under Other helpful links... choose Delete a form
  • Click Delete next to Form 8857 for Innocent Spouse
  • Click Delete next to Form 8379  for Injured Spouse

For injured spouse:

  • Once in your return, in the search box on the blue dashboard type "injured spouse"
  • Click on blue "Jump to injured spouse" link
  • Answer Yes to Do you want to claim innocent or injured spouse relief? on the "Innocent or Injured Spouse Relief" screen
  • Do not enter a year on the "Innocent and Injured Spouse Relief" screen, just click Continue.  (Although having Injured Spouse in the screen title, it is asking for innocent spouse years only.)  
  • Click Continue on the "Your Request For Innocent Spouse Relief"
  • Once on the "Let's See if You Qualify for Injured Spouse Relief' begin to very carefully answer all questions. 
  • On the "Tell Us More About Your Situation" make sure to click the first box for filing joint, a box that describes your situation (federal tax,child support, student loan debt, etc) and also the box indicating you are not required to pay the past due amount.
