My girlfriend listed our daughter on her taxes, but she put that we had an agreement and that the other parent would be claiming the child. We have looked at her taxes and our daughter isn't listed under her dependents and she didn't get a tax credit for her. However, my taxes keep getting rejected because it says "Each 'QualifyingChildSSN' that has a value on Schedule EIC (Form 1040) must not be equal to another qualifying child ssn on another accepted return for the same tax year'. Is there any way to fix this problem?

You will have to print and mail in your return. Since your daughter's SSN is already in the IRS computer as having been included on another return (even though she's not claimed as a dependent), you will not be able to e-file your return with her SSN on it.
I just got off the phone with a agent from turbo tax and was told I would have to amend my tax return and remove them from my return. I did the same thing where I did put their ssn but clicked that I would not be claiming them as dependents because their mom would be doing so. So now I’m told that by doing that I basically claimed them on my tax return which makes no sense.
Divorced or separated parents can 'split' child credits.
The Custodial Parent is the only one who can claim Head of Household and the EIC Credit.
The Non-Custodial Parent can claim the child for Dependency and the Child Tax Credit (if the other parent agrees).
You have to be very careful making these choices when entering your child in the MY INFO section.

This is only for parents who don't live together. For Parents who live together, the one with the highest AGI usually claims the child.
