My spouse owes money to the IRS and NYS... I filled out the injured spouse form, but is there anything i need to fill out for New York?

New York State has an equivalent of the federal injured spouse status, which is reported on New York Form IT-280, Nonobligated Spouse Allocation.

 

You can complete this form in TurboTax:

  1. While in your New York return, you will see a screen, Additional Tax Situations.  Click on the Start box next to Prevent your credits from going to a debt owed by your spouse.  [See Screenshot #1, below.]
  2. On the screen, Are You a Nonobligated Spouse, click the Yes box.
  3. On the next screen, Who is the Nonobligated Spouse, mark the circle next to the correct name and click Continue.
  4. On the Check Your Qualifications screen, mark all the boxes that apply.  [Screenshot #2]
  5. On the next screen you will be asked to allocate income that belongs to the injured spouse.  Click Continue when finished.
  6. You will be brought back to the Additional Tax Situations screen.  Click on the box Done with Other Forms.
