No.   You can still claim him if he is under 19 or under 24 if he is a full time student.  Be sure he checks the box on his return that he can be claimed on someone else's return, even if you don't claim him.

Here are the rules----if he is a full-time student you can claim him until the year he turns 24.   He can file his own tax returns to seek refunds, but has to say on his own return that someone can claim him as a dependent.

 

 

 

WHO CAN I CLAIM AS A DEPENDENT?

 

You can claim a child, relative, friend, or fiancé (etc.) as a dependent on your 2024 taxes as long as they meet the following requirements:

Qualifying child

  • They're related to you.
  • They aren't claimed as a dependent by someone else.
  • They're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
  • They aren’t filing a joint return with their spouse.
  • They're under the age of 19 (or 24 for full-time students).
    • No age limit for permanently and totally disabled children.
  • They lived with you for more than half the year (exceptions apply).
  • They didn't provide more than half of their own support for the year.

Qualifying relative

  • They don't have to be related to you (despite the name).
  • They aren't claimed as a dependent by someone else.
  • They're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
  • They aren’t filing a joint return with their spouse.
  • They lived with you the entire year (exceptions apply).
  • They made less than $5050 in 2024 (not counting Social Security)
  • You provided more than half of their financial support.

When you add someone as a dependent, we'll ask a series of questions to make sure you can claim them. There may be other tax benefits you can get when you claim a dependent.

I know i "can" till he's 19. But he wants to claim himself for 11 months. (He's turned 18 end of January 2024)

And I'm fine with that but is there anyway I can claim "just january" or is it all or nothing

It is "all or nothing."    And what he "wants"  is not the way it works.  The rule is that if he CAN be claimed he must say on his own return that someone else can claim him as a dependent.  His refund will not be affected.   He can still get a refund of tax withheld from his paychecks if he had more withheld than his tax liability.

CAN I FILE A RETURN IF I AM A DEPENDENT?

If you can be claimed as a dependent on your parents’ return, you can still file your own return so that you can receive a refund of taxes withheld.  Your W-2 will show federal tax withheld in box 2, and state tax withheld in box 17.  (You will not get back anything for Social Security or Medicare withheld.) Be sure that on your own return you say that you can be claimed as a dependent on someone else’s return.

If you can be claimed as a dependent and you answer the question in My Info incorrectly, here is what happens if you e-file first:  Your Social Security number goes into the IRS system as having been used.  When your parents try to e-file, their e-file is rejected and they will find it impossible to e-file their own tax return.  Then they will have to print, sign and mail their return and wait for months for it to be processed.  You, meanwhile, will have to file an amended tax return on a special form called a 1040X, which also takes months for the IRS to process.  So make sure you know the correct answer to "Can anyone claim you as a dependent on their tax return?"

No, you can't claim your son for one month of the year. You can claim him for the entire year or not at all. Have your son review the IRS website: Check if you need to file a tax return to determine if he is required to file a tax return.

 

Even if your son files a tax return, you may still be able to claim him as a Qualifying Child Dependent or a Qualifying Relative Dependent.  This depends on his age and how much money he made, along with other requirements. To determine if you can claim him as your qualifying child, the following questions must be true.

 

For a Qualifying Child Dependent:

  • He must be related to you. 
  • He can’t be claimed as a dependent by someone else. 
  • He must be a U.S. citizen, resident alien, national, or a Canadian or Mexican resident. 
  • If he's married, he can’t file a joint return with his spouse. 
  • He must be under the age of 19 (or 24 for full-time students). 
    • No age limit for permanently and totally disabled children. 
  • He must have lived with you for more than half the year (exceptions apply). 
  • He didn't provide more than half of his own support for the year. 

If your dependent doesn't meet the rules for a qualifying child dependent, he may meet the rules for a qualifying relative dependent:

 

For a Qualifying Relative Dependent:

  • His income must be less than $5,050
  • You provided over half of his support
  • He's not filing a joint tax return if married unless filing to claim a refund of withholding
  • He Must be a U.S, citizen, U.S. resident, U.S. national or resident of Canada and Mexico
  • He must live with you all year, unless he falls under one of the categories—Does a dependent for 2024 have to live with me?
