My son did not file 2019 tax. He is 24 and only made $4000 in 2019. I claimed him as a dep. Is there any way he can still receive either stimulus payment?

No.  Not for 2019.  If he only had $4000 of income then you could claim him as a dependent and he was not eligible to get the stimulus money based on a 2019 tax return.

If the situation has changed for him in 2020 and he cannot be claimed as someone else's dependent for tax year 2020, then he can get the stimulus money when he files a 2020 tax return.

But the rule is if he CAN be claimed he has to say he can be claimed on his own return----so does he fit the criteria to be claimed for 2020?

WHO CAN I CLAIM AS A DEPENDENT?

You can claim a child, relative, friend, fiance (etc.) as a dependent on your 2019 taxes as long as they meet the following requirements:

Qualifying child

• They are related to you.

• They cannot be claimed as a dependent by someone else.

• They are a U.S. citizen, resident alien, national, or a Canadian or   Mexican resident.

• They are not filing a joint return with their spouse.

• They are under the age of 19 (or 24 for full-time students).

    • No age limit for permanently and totally disabled children

They live with you for more than half the year (exceptions apply).

Qualifying relative

• They don't have to be related to you (despite the name).

• They cannot be claimed as a dependent by someone else.

• They are a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.

• They are not filing a joint return with their spouse.

They lived with you the entire year.

• They made less than $4300  (not counting Social Security)

• You provided more than half of their financial support. More info

When you add someone as a dependent, we'll ask a series of questions to make sure you can claim them.

The stimulus check is an advance on a credit you can receive on your 2020 tax return.  If something went wrong or you did not get the stimulus check this year, you can get it when you file your 2020 return in early 2021—if you are eligible. It will end up on line 30 of your 2020 Form 1040.

Forget about 2019.

It is his 2020 tax return that controls.

If he is eligible to be claimed as a dependent, he must check the box that says he can be claimed, even if the person who could claim him doesn't want to.  For 2020, he can be claimed

a) if he earned less than $4250 of taxable income and filed no tax return, or only filed a return to claim a refund of withholding and claimed no other credits;

b) you paid more than half his support.

If he files a 2020 return and can't be claimed as a credit, the first $1200 payment will be included in his refund.  Possibly also the second payment, if President Trump eventually signs a bill.

Q. Is there any way he can still receive either stimulus payment?

A. Yes, he just has to wait until 2021.

In essence, the stimulus check, received in 2019, acts as an advance of his 2020 income tax refund. This means when he prepares your 2020 income tax return, in early 2021, there will be a line to include the section 6428 credit (line 30 on the 2020 form 1040). The credit on his 2020 return is subtracted by any amount received as a stimulus check in 2020. If the amount he received (0 in his case) as a stimulus check is less than the credit he is due, the difference will be included as part of  his 2020 refund.

As others have said, this is contingent on him not being eligible as your dependent in 2020.
