My mother supported me and my child for the whole year can she claim us as dependents? Also my boyfriend supported me for the 5 months my child was born last year, can he claim us?

Who would benefit most from claiming us? Or should I just claim my child, I'm single, 1 child, and I live with my mother.

Yes, your mother can claim you and your daughter as dependents if the following conditions were met

Qualifying Relative

These 4 tests (all of them) will qualify a relative as a dependent:

  • Not Qualifying Child: They are not your or another taxpayer’s “qualifying child” 
  • Gross Income: Dependent has to earn less than $4,050 in 2016.
  • Total Support: You provide more than half of the total support for the year.
  • Member of Household or Relationship: The person (a friend, girlfriend, non blood relative) must live with you all year as a member of your household or be one of the relatives that doesn’t have to live with you (mother, father, brother, sister, aunt, uncle, stepmother, stepfather, your child, stepchild, foster child, adopted child, grandchild, etc) Note: this list is not exhausted.

This means that you cannot file a tax return claiming yourself and your daughter as dependents because your mother will be claiming the two of you.  As far as living with your boyfriend for 5 months, he cannot claim you and your daughter because you and your daughter are classified as non-blood relatives of his and both you and your daughter would have had to have lived with him for the entire year, (as mentioned above).
