If you two are married and you've already filed the return, then it is simply a "he said / she said" situation that the IRS does not get in the middle of. He has no case, truly, so he can attempt to report you but he will get rejected. Any decent (using this lightly) lawyer would tell him the same thing that he has no case. I am sorry that you are dealing with this.
when a joint return is filed the IRS says both spouses must consent to it. since this is a case of he says you say you need to speak to a tax attorney.
It is possible to change from married filing jointly to married filing separately only if the change is made before the tax deadline of April 15. The person whose name is first on the tax return would file an amended return changing to married filing separately and removing their spouse‘s income in deductions. The spouse would file an original married filing separately return.
I don’t tell you to do this, I tell you this would be the procedure if you decide to do this.
