My husband is a non-resident alien, do I need a tax ID for my spouse?

I quit my job in the USA and now live in the UK. I had no UK income in 2016. My spouse is a non-resident alien with no USA income.

Without a number generated for such, your wife can't file jointly with you..."yet".

However, what you CAN do NOW is file Married Filing Separately...for "now".

Once your wife gets her ITIN, "then" file an amended return as Married Filing Jointly.

Rule of thumb: You've got three years to file/amend a return if YOU are getting money back. If you owe the government, they have until the end of time for you to file.
