My fiancee filed his taxes, and put our sons information down and said that he was claiming him this year that the other parent was. Now it's rejecting my taxes?

How I'm suppose to fixed my rejected tax return, if it says he didn't claim him as a dependent but put his info down for  dependent.

BF messed up.   If all of you live together as a family then the child can only be shown on one of your tax returns--not both.   So.......if you are the one claiming the child then you now have to print, sign and mail your return because your BF already put your child's SSN into the system.   BF can wait for his return to be processed and amend it to remove the child from his return.

Turbo Tax already approved his tax return.

@hatayapackard13- No.   TurboTax does not ever "approve" a tax return.   The IRS accepts or rejects a tax return and then the IRS can approve of a refund.  Approval does not come from TurboTax.

But since the IRS accepted your BF's return with the children's SSN on it, you cannot e-file this year.   You have to mail your tax return in order to claim your children and get the child-related credits.

if your BF listed the child on his return the child was claimed as his dependent.  normally, this is not allowed.  the reason is that he is your qualifying child.  your BF is claiming the child as a qualified relative. However, the tax laws say a person can't be claimed as a qualifying relative if they are a qualifying child to someone else.

 

however, there is an exception to this in the tax laws. the child would not be considered your qualifying child If you are not required to file a tax return and (1) do not file a tax return or (2) files solely to claim a refund of taxes withheld (Notice 2008-5)
