My ex husband stays w/me due to an accident that left him disabled. He is NOT deemed disabled by the state, he can't work. Can I claim him? WE ARE NOT MARRIED..

We have been fighting the state for his disability. 5 verbrates in the middle of his back that are pushed against his spine, almost cutting off his spinal fluid. If he lifts anything heavy, he could be paralyzed. The doctors won't do surgery due to his age, 29 then. He just turned 30.

Yes, you may be able to claim your ex-husband as a dependent if:

  • You provided more than half of their support.
  • He made less than $4,050 in gross taxable income. (Social Security income generally doesn’t count here.)
  • He lives with you (365 days in the year) or they are related to you.
  • He isn't a dependent on someone else’s taxes.
  • He isn't doing their taxes with a spouse (married filing jointly).
  • He is a U.S. citizen, resident alien, national, or a Canadian or Mexican resident. 

You can’t claim a dependent if you are a dependent on someone else’s taxes
