My child's father claimed her on his taxes when he didn't have the right to do so. She lived with me and he never even paid child support on her. what do I need to do?

My child's father claimed her on his taxes when he didn't have the right to do so. She lived with me and he never even paid child support on her. what do I need to do?

You will need to mail your return to the IRS, or you will need to e-file without your daughter.

The IRS will write to you and the other person and require you both provide documentation to prove the child's residency with you. You will need to send a collection of the following:

  • Rent receipts
  • Utility bills
  • School records for your child (if applicable)
  • Doctors notes, or a pastors note.
  • Notes from neighbors, or third party people that the child lives with you
  • Anything you can come up with the proves the child was with you.

The IRS will decide who can claim the child as a dependent. If the IRS determines that you get the exemption, they will pay you your refund (if the haven't already) and they will make the other person repay the IRS.
