You cannot claim a child for half a year.  As custodial parent, you are entitled to the dependency exemption.  Your child's parent can only claim your child if you release your right by providing him with a signed Form 8332.

If he has filed his taxes and claimed your child, you should file your taxes by mail.  Attach a statement that your child's parent is not the custodial parent and is not entitled to the dependency exemption.
