Multiple w2 froms from same Employer for filing with two states

Hello and thank you in advance.

My son's assigned office is in New Jersey. He also resides in New Jersey. He works there 4 to 5 days a week.

He has a dotted line reporting into a manager who works in NY. He goes into the NY office about once a week or sometimes once every two weeks.

He received 2 W2 forms from his employer

 

The NJ one which again is his home office has the entire w2 filled out. His earning lets say is $70k

The NY W2 has an inflated earnings about 4k less - $66k.  The only items on this W2 that are filled out are the inflated earnings on line 16 and ny state income tax  in box 17. Nothing in boxes 1-14

 

So two questions.

1) Looking at his year end Payroll he as an item listed for NY earnings around $6,800. Since NY threshold for filing single non residence is $8,000 does he even have to fill out a NY state Return? 

 

2) If not great. If he does or next year I'm sure he'll earn over the threshold - how do I handle this exactly?

Multiple w2 froms from same Employer for filing with two states

1. A NY return is not required for nonresident when the income is less than the standard deduction which can be $3,100 or $8,000. You know that he qualifies and is not required to file this year. See Nonresident forms 

2. NJ taxes retirement income you set aside while NY does not so the income between the two states is different in calculating. The program will automatically take all state income over to NJ to be taxed. You will enter the full NY amount on the w2 and the remainder that belongs to NJ.

For example:

  • Fed earn $80k
  • NJ earn $83k
  • NY earn $12k

Your w2 entry would have: 

  • federal where it belongs, 
  • the NY of $12k and 
  • NJ of $83-12NY =$71k on NJ state line
