Me and my husband (both 19 he’s in the army) got married in November 2025. My parents still plan on claiming me on their taxes. How do I allow them to claim me while being married? My husband tried to file his taxes and got the error “F1040-461 - If Form 1040, 'SpouseClaimAsDependentInd' is checked, then the filing status of the return must be married filing jointly.” thanks in advance

What filing status did your secret spouse try to use? Did he try to file "married filing separately" or did he try to file "married filing jointly?"
Are you a college student? Is that why your parents expect to be able to claim you as a dependent? Or....if not a student, did you have more or less than $5200 of income in 2025?
This reminds me of my freshman college roommate who ran off and secretly married a motorcycle gang guy-- it took about three weeks for the parents to find out and it really hit the fan. But I ended up with big dorm room all to myself.
He used married filing separately. And yes I am a full time college student.
If he filed married filing separately you have to do the same thing---file married filing separately. Did you have any 2025 income at all to enter on a tax return?
Or-- the two of you can file a joint return and he can say on the return that his spouse can be claimed as someone else's dependent. He must enter your SSN, name, etc. on that tax return.
You might get away with secrecy for awhile....but these things have a way of getting out. If the IRS does not reject your parents' return for duplicate use of your SSN, they may not find out from your tax return.
Yes I will be filling the same when my W-2s come in. My parents aren’t speaking to me since I am not the sexuality they prefer so maybe when they do speak to me I can tell them I’m married but until then I can’t. Also, my husband’s federal taxes were already approved after we amended them. We are just waiting to see if the state approves them.
If your spouse filed a joint return, that return was of both of you and was supposed to have all of your income entered on it too. When you file a joint return it is ONE tax return for both people---not two returns. So---if he already filed a joint return he has to wait for it to be fully processed by the IRS and then it has to be amended to include your income (your W-2's). An amended return cannot be filed until the original return has been fully processed, and you have to use a special form called a 1040X which will not be available until late February. And then....it takes the IRS months to process the amended return.

Wait---he filed married filing separately? And it was accepted? Did he put your SSN on his return? Did he click that you can be claimed as someone else's dependent? If that is how he filed, then you also have to file married filing separately, and you will have to enter his SSN etc on your tax return.
Yes he filed “Married Filing Separately” with my SSN and clicked I can be claimed as someone’s dependent. I will also file this way when I get my W-2’s. Does this way allow my parents to still claim me?
Yes, your parents can still claim you as a dependent even though you are married filing separate, as long as you qualify as a dependent otherwise.
