Married living in different states

Hi,

I am an indiana resident while my husband moved to OH at the end of 2022. We got married in 2022. We have one child under 13. I only work part time while going to school in Indiana while he works full time in Indiana as an OH resident. I was wondering if it would be possible to file separate tax returns both federal and state.

Filing separate is an option for both federal and state, but you will almost always pay more in tax if you are married and choose to file separate, instead of joint.  That's because of some special rules that apply when you're married and file separate.  For more information, see page 7 of IRS Publication 501

it might be possible to file a joint federal return and separate state returns. Confer with a tax specialist. 

this could save you $1000's or more  federally

 

for example a married couple each making $30K filing separtely or jointly would pay a total of about $6,700 federally. while MFS if one made $50K and the other made $10K would pay about $7,300 but filing jointly $6700 the same as two married people making $30K each 

 

 

if your situation MFS might cost you the earned income credit, and reduced or eliminated child tax credit and child dependent care credit.
