A spouse can NEVER be a dependent. If you are legally married then you file as Married Filing Jointly or Married Filing Separately. In most all cases filing as MFJ is best even if one spouse has little or no income.
Prior to the tax reform law of 2017, it was possible to claim a spouse's personal exemption when filing as married filing separately, but this was not the same as claiming them as a dependent. That provision was eliminated.
