If i was legally divorced on 12/13/2016 date, can i still file married filling joint for 2016, if we both want to?

If you were not legally married on 12/31/2016 you can only file your 2016 tax return as Single.  Or if you have a qualified person as a dependent and pay for over one-half the cost to maintain your home you can file as Head of Household.  In no way can you file as married if you were not married on the last day of the year.
