If your child actually lives with his/her other parent, the other parent is considered the custodial parent by the IRS. The custodial parent has the primary right to claim the child. The non-custodial parent cannot claim the child unless the custodial parent relinquishes his/her right by providing the non-custodial parent with a completed IRS Form 8332, or unless it's spelled out in a pre-2009 divorce decree.
