If in the beginning of 22 I only worked two months. rest of the year my mother took care of me,my son was born in October but I got a w-2, how do I let my mom claim us

I’m not sure if I should file this w-2 and if I do will it effect my mom claiming me and my baby. Like what can I do here? Can she still file and claim us on her taxes?

You say that you worked for a "couple of months" .....as long as you earned less than $4400 in 2022 you can be claimed as a dependent on someone else's tax return.

If you and your child were supported by your mother then she can claim both of your as dependents on her tax return.   Since you can be claimed as a dependent you do not enter anything about your child on your own tax return.  A dependent cannot have a dependent.   Your mom can get the child-related credits for the grandchild by claiming the child on her return.

 

You can file your own tax return in order to seek a refund of the tax withheld from your pay---it is in box 2 of your W-2----but when you prepare your return you must say in My Info that you can be claimed as someone else's dependent.  That is very important.

To claim a grandchild as your dependent

When you enter the child’s name in Personal Info, you will be asked “What’s your relationship to  [child’s name]?”  

           Choose “another person”

            a drop down menu will appear that lets you choose grandchild

Q. How do I let my mom claim us?

A. By not claiming yourself or your son, when and if you file a tax return.

 

In your situation, it's essentially optional whether the parent or grandparent claims the child.  She can claim you, as long as your W-2 was less than $4400 or you are under 19 or under 24 and a full time student for parts of 5 months. 

 

Q. I’m not sure if I should file this w-2?

A. You do not need to file it if box 1 is less than $12,950 and there is no amount in box 2.  If  there is an amount in box 2, you can file to get it refunded.  The amounts in boxes 4 & 6 cannot be refunded. 

 

Q.  Can she still file and claim us on her taxes, if I file a tax return?

A. Yes.  You not add your child on your tax return.  You check the box that says someone else can claim you as a dependent (TurboTax does this for you). 

 

Q. Will it effect my mom claiming me and my baby. 

A. No.

Possibly,  please confirm the date as 2021, or 2022.  In either case, the situation is the same.  If your total income was under $12,500 (for 2021) you do not have to file a tax return.

 

To qualify as your Mom's dependent, you must qualify under all of these conditions:

  • You're related to your Mom.
  • You aren't claimed as a dependent by someone else.
  • You're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
  • You aren’t filing a joint return.
  • You lived with you the entire year (exceptions apply).
  • You made less than $4,400 in 2022.
  • You didn't provide more than half of your financial support.
