If I created an LLC single member in 2023, and then I added my husband as a member of the LLC in 2024, do I have to file a 1065?

I created an LLC single member in 2023 and I requested an EIN as a single member of a LLC, and I included the company in my schedule C and in the tax returns 2023. In 2024, I added my husband to the LLC with the state of Florida, and now I do not know if I have to file an 1065. I will be removing my husband from the company this year, and we did not have any income in 2024. What are the best options in this case?

Technically by adding your husband as a member of your SMLLC, you created a partnership, which should file Form 1065. However, if you have no activity to report for the year, you don't need to file a business return. Simply report no income or expense on the Schedule C of your personal return. As long as you are the only member of the SMLLC, you can continue to report this business on Schedule C.
