I'm the custodial parent but did not claim my son as a dependent. No Form 8332 was on my return. Father's return is now being rejected. How do I add it to my filed return

Do you mean that you want to say you signed 8332 so that the other parent can get the child tax credit?  You will have to amend your own tax return to fix that.  But that still means the other parent cannot e-file this year.  The only way they can file now is by mail since you already put the child's SSN into the system.

Are you the custodial parent?  Do you have an agreement with the other parent to allow the other parent to claim them--due to divorce or that you live apart and share custody?  Did one of you sign a Form 8332?

 

If there is a signed 8332 then the custodial parent retains the right to file as Head of Household, get earned income credit and the childcare credit.  The non-custodial parent gets the child tax credit for children under the age of 17.

 

As far as the IRS is concerned, the custodial parent is the one with whom the child spent the most nights during the tax year--at least 183 nights.

the custodial parent does not give the 8332 to the IRS. the signed copy is given to the noncustodial parent and must either be included with their return or if they successfully e-filed send it with form 8453.  not sure why if everything was done properly why the NCP can't e-file.

Thanks,  @xmasbaby0 . I'm very confused by Turbo tax because they asked me questions around the arrangement with the noncustodial parent and it clearly shows on the return that I'm HOH but not claiming my son as a dependent on the return.  I am getting some reimbursement for child care expenses paid but my understanding from TT and the IRS website is that that is allowed. Moreover, there was no mention of Form 8332 when I was completing my return on Turbotax, which would have been helpful. Thank you for help!

Thanks, @Mike9241 . I appreciate your input. I've "added" the form to my Turbo Tax file, amended, and have printed it out and signed it for the noncustodial parent. Hopefully that helps. As mentioned in my other reply, my return indicates that I'm HOH but not claiming any dependents but am getting credit for some child cares expenses (which I thought was allowed). Hopefully, we can get it to work. Thanks again!

It asked you in My Info it asked you if you have a custody agreement or other agreement and then it asked if the other person will claim the child.  Perhaps you missed or misunderstood those questions and did not answer them.
