Answer interview honestly; It's possible you can both get Stimulus. It was an an advance, based upon projected entitlement.

If you are not a dependent in tax year 2021, you can claim the third stimulus of $1,400 as the Recovery rebate credit on your 2021 tax return.

 

In TurboTax Online, to claim the Recovery Rebate credit please do the following:

  1. Sign into your account and continue from where you left off
  2. Click on Federal in the left-hand column, then on Federal Review on the top of the screen
  3. On the next page titled Did you [or your spouse] get a third stimulus payment?, answer No
  4. Follow the interview and answer all questions
  5. TurboTax will determine that you are entitled to the stimulus
  6. The Recovery rebate credit of $1,400 due to you will show as a credit on line 30 of your form 1040 and will be added to your refund..

 

Your mother does not have to repay the amount she received for you. 

 

The IRS says: No, there is no provision in the law that would require individuals who qualify for a Third Economic Impact Payment or an additional payment based on their 2020 or 2019 information, to pay back all or part of the payment if, based on the information reported on their 2021 tax returns, they would have qualified for a lesser amount.
