If her mom has already filed and had her tax return accepted while claiming your daughter, your only option is to file your taxes by mail if you want to claim your daughter. The IRS will investigate to determine which parent has the rightful claim.

My daughter didn’t check that she could be claimed as dependent on her tax return. She then ammended her return to fix it but my tax return is still getting rejected
