I have been separated from my husband for over 2 years now and have a divorce on process can I file as legally separated?my w2 said married .we don’t leave in the state

If you are considered unmarried (definition to follow) you can file either single or Head of Household (with a qualifying dependent).

If you are separated by divorce or a separate maintenance decree on Dec. 31, 2017, you can file single.
