I have an offset on my name for student loans, however I did not work this tax year. My husband made the entire income, Will my offset affect his return?

I have an offset on my name for student loans, however I did not work this tax year. My husband made the entire income, Will my offset affect his return?

If you're filing jointly, any refund you have coming will most likely be offset by any student loan debt of yours.

HOWEVER... you could either

  • File with the married filing separate status, or, what's generally a better solution,
  • File an "Injured Spouse" form that would allow your husband to get his portion of the refund from your married filing joint return.
