I have a sister who has been dependent on me and lived with me the whole year. Can I claim her as a dependent if she doesn't have a green card, but she has a SSN?

She has applied for asylum and her file is processing. She has a social security number, but not a green card. She worked for a few weeks and has a w2 form. But she did not make more than $2000. I have been paying for more expenses and she lives with me and I pay for rent and other stuff.

Yes, if your sister as a SSN, and you supported her, you can claim her as a dependent.

Here are the qualifications for claiming an adult as a dependent:

To claim an adult as a dependent:

·       You provided more than half of their support.

·       They made less than $4,150 in gross taxable income. 

·       They are not a dependent on someone else’s taxes.

·       They are not filing a joint return with someone else.

·       They are a U.S. citizen, resident alien, national, or a Canadian or Mexican resident. 

If you sister is a child, here are the qualifications for claiming her:

*            be your child (or adoptive or foster child), sibling, niece, nephew or grandchild; 
*            be under age 19, or under age 24 and a full-time student for at least five months of the year; or be permanently disabled, regardless of age; 
*            have lived with you for more than half the year; and
*            have provided no more than half his or her own support for the year.
