I have a joint hsa account so the question asking did i put it into my husbands or mine is confusing me.

You can't have a joint HSA. HSA's are individually owned (like an IRA). Spouses can have access to spend the funds and use for qualified medical expenses however (via a benefits card usually).

Answer from the point of view of who owns the account. Who is the account holder?

You will need to know which person on the tax return is the owner of the account when you are going through the Health Savings Account (HSA).  Typically, the account owner will be the one who has the High Deductible Health Plan (HDHP) insurance.

It is possible that both a taxpayer and spouse on the same return could each have an HSA in their name if they both have separate insurance coverage.

@geshleman , if you do not already know, contact your HSA custodian to find out which of you opened the account.  It seems virtually impossible that the custodian could have opened the account in more than one name.

Note that even though the account only belongs to one person, distributions from the HSA can be applied to qualified medical expenses of you, your spouse and your dependents.
