I have a H4 visa dependent child (lived with me in the US the entire tax year) and I have my child ITIN. Can I claim the child to be my dependent.

Child is non-US citizen & non green card hold. Child is on H4 dependent visa, meets substantial presence test

I have a H4 visa dependent child (lived with me in the US the entire tax year) and I have my child ITIN. Can I claim the child to be my dependent.

Yes, you may claim your child as a dependent since they lived with you for the entire year. Because of the ITIN however, they would qualify to be a "other dependent." eligible for a $500 other dependent credit. If they were under 17 in 2025, they would need a valid Social Security number for you to claim the child tax credit.

 

To claim them as a dependent, though, they would need to meet the following requirements.

 

  1. Relationship: They must be your son, daughter, or eligible descendant.
  2. Age: For the $500 credit, there is no age limit as long as you provide more than half of their support. 
  3. Residency: They must have lived with you for more than half the year (which they did).
  4. Support: You must have provided more than 50% of their financial support.
  5. If they are 19 and over and not a student, they must not earn more than $5200 in 2025.
