I got a rejection notice saying my child had been claimed on someone else's return. What do I do?

You can do one of the following options:

  1. If you can determine who claimed the children (often is the other parent if you are filing separate from that person, or a grandparent) ask them to amend and remove the children from their return. This will have the least hassles if possible. You would either need to mail your return, or extend and wait several weeks (between 10-16 weeks) to try and e-file again.

  2. If determining who claimed the children is impossible, mail your return to the IRS with the children claimed on your return. You will need to gather documentation to show that they are your children and they lived with your for more than half of the year.

The IRS will likely hold your refund until they can figure out who was entitled to the dependent. They will write to you and the other person and require you both provide documentation to prove the child's relationship and their residency with you. You will need to send a collection of the following:

  • Birth Certificate (relationship)

  • Rent receipts

  • Utility bills

  • School records for your child (if applicable)

  • Doctors notes, or a pastors note.

  • Notes from neighbors, or third party people that the child lives with you

  • Anything you can come up with the proves the child was with you.


After the IRS determines that the dependent is your’s they will assess additional tax (to payback the child tax benefits) penalty, and interest to the other individual.

I got a rejection notice saying my child had been claimed on someone else's return. What do I do?

The other person who claim my children on their taxes is the boyfriend of my children's mother. He is not register on her Section 8 application. I support my children although they did not live with me the half year but do stay with me on weekends throughout the year.
