I gifted my ESPP to my daughter, they show up in 1099 from my broker as income! how do I exclude them?

To clarify, did you sell the shares and give your daughter the proceeds or did you give her the shares of stock? Did you receive Form 3922 from your employer?

If you did not sell any shares, I do not understand why you received a 1099-B for this transaction.

I take it back, I doubled checked the transaction history and turned out these were an automatic short sale from ESPP that I later changed to not sell automatically. the gifted stocks are not showing in 1099-B. thanks for your quick response :).
