TurboTax failing to include the explanation for Spouse's Form 5329 requesting a waiver is a bug in TurboTax that has been previously reported.

Your present options are to include Spouse's explanation on the same explanation as Taxpayer's explanation, or paper-file by mail and add a separately prepared explanation.

What is the 5329 for?   It sounds like you entered the form that triggered the 5329 for the wrong spouse (such as a 1099-R).

When I open forms, both 5329 are properly filled out, except for the explanation part. I can manually enter the proper explanation for each form in the forms listing. When I go back into program only one explanation is viewable. When I return to forms option, only 1 explanation shows attached to 1 or other 5329. If I fill out explanation or leave blank in program, then that overrides what I have manually entered in forms option. Am I confusing everyone? 🙂

I just remembered, one other workaround is available if you are using the CD/download version of TurboTax.  You can properly add Spouse's explanation in forms mode by opening Spouse's Form 5329 (Form 5329-S) and clicking the Explain button in the Waiver of Tax Smart Worksheet in Part IX of the form.  The problem only occurs if the explanation is entered in step-by-step mode.

TurboTax will create a form 5329 for each of you if you both had an early distribution from your retirement accounts [5329-T and 5329-S].

Be sure to mark the 1099-R entries correctly to identify that the distribution belonged to you OR your spouse.
