I am married, filing jointly. Husband made very little income in 2016 but owes back child support. How do I ensure MY portion of refund is not taken?

I've started to file the spouse relief form but it makes it sound like it's only if they've already taken my portion in past years.  Please help!

It's the same form (Form 8379) whether your portion was or is expected to be offset by the IRS.
