While you may be "head" of the household in some sense, the income tax status "head of household" only applies to single parents (separated or divorced) who have at least one qualifying dependent.

If you file a joint return, you must include all your combined income. 

If you file separate returns, your spouse must file because their income is more than $12,000.  Filing separately usually ends up with higher taxes or lower refunds, because many deductions and credits are limited or disallowed.  If you itemize deductions, you spouse must also itemize even if they don't have any deductions, they can't use the standard deduction.  And in turbotax Online version, filing separately requires two separate online accounts with different user names and passwords, and you will be charged two separate fees, unless you qualify to file for free.

If you file separately, your spouse must also file if (a) he had self-employment income of more than $400, or (2) you are in a Community Property State.
