When you marry someone else, your biological children become his children through marriage as far as the IRS is concerned. You may claim the children while filing jointly with your husband unless you are not the custodial parent or you have given the custodial parent Form 8332 and giving him permission to claim the children. Even in this case, you may still be able to claim certain benefits for the children on your tax return.
